Interesting topic, though.

If I might be permitted a hijack, the law in NC reads that if you wake up in the night and find a stranger is in your house you can not use deadly force to combat him -- if you shoot him, you will be charged with voluntary manslaughter. Even if he's in the act of ripping off your property, you still cannot use deadly force.

However, if he turns and throws that TV he's stealing at you, or attacks you in such a way that you can claim a fear of great, bodily harm, then you can shoot the fucker into a soggy version of a rusty colander in all good conscience. Also, the law does not prevent you from climbing his frame, tearing off his jaw, and raking him out with his own, methamphetamine-twisted teeth, if the legal excuse for firearms is not there.

Here's another one: If you are the instigator of a fight and suddenly find yourself on the losing end of it -- the very badly losing end of it -- you cannot use deadly force to get the guy off you. If you do, it's VM again and you're gonna go to jail. Your opponent is still the victim, unless..... unless you quit: "Ok, I quit, you win, you da man, lemmee up, I'm out'a here!" If, at that point, he continues to punch, kick and stomp you, you become the victim, in danger of great bodily harm, or death, and can now pull Roscoe and send him on to his dubious reward with all of the blessings of the law. Interesting, no?

Defending your self is always the right thing to do, but you need to know how to do it, and, if deadly force is involved, know when.
